Studio Carullo supports the operators who participate in the procedures for awarding public contracts and concessions. Provides legal support in the tender preparation phase, for example through consultancy on the interpretation of the tender documentation, such as in cases where clauses of the tender, the specification or the specifications are not clear about the possibility of certain methods of participation or in regarding problems of the technical offer.
If appropriate, Studio Carullo offers support in the drafting of requests for clarification and we support – even with a quick and direct interlocution – the tender offices of the companies in the phase of participation in the tender, also in the drafting of temporary grouping agreements and pooling contracts. Assists bidders in relations with the contracting station, by proposing requests for access to documents, requests for cancellation in self-defense, out-of-court notes and warnings.
The Firm also represents the client at every stage and degree of public procurement disputes and litigation before all administrative and judicial authorities, including regulatory bodies and in arbitration. The Firm assists private companies, both Italian and foreign, participating in public tenders in relation to the measures taken by the contracting authorities in the context of the same procedures (awards, exclusions, admissions of competitors, etc.).
The Firm also assists public and public-private subjects required to comply with public evidence procedures in the defense in court against the appeals brought by the participants in the procedure and in proceedings before the competent Independent Authorities (AGCM and ANAC). We represent the client in disputes relating to the execution phase of public contracts.

In fact, the Firm provides specialized advice to candidates for public competitions who are faced with exclusion clauses in the tenders, critical issues in carrying out the tests, errors in the rankings and other problems of the insolvency procedures.
Thanks to its interdisciplinary skills, the Firm also offers support in the post-employment phase, in labor law issues but also in the specific aspects of the public employment relationship, for example in relation to mobility procedures or disciplinary proceedings.
The Firm assists the defendants in liability actions for tax damage before the Court of Auditors.

The Firm provides consultancy on a wide range of issues relating to environmental law and related to authorizations and processes of environmental impact assessment and integrated authorization; provides assistance in relation to waste management, water disposal, remediation of contaminated sites, air and noise pollution.
The Firm has investigated the legal issues of the integrated water service, (providing consultancy to the regional administrations for the activity concerning the implementation of the so-called Galli law, procedures for assigning the integrated water service) and those related to environmental management (waste disposal, landfill management, environmental damage). Over the years, legal connections have also been developed between environmental procedures (so called VAS and VIA) and urban planning, collaborating with bodies and private implementing bodies.

In the field of urban planning and construction, the Firm provides advice on planning, binding legislation, building permits.
In particular, it offers a qualified assistance and urban planning – administrative consultancy, in complex operations, among other things, of transformation and redevelopment of entire territorial contexts (preparation of territorial and commercial planning instruments; management of administrative implementation procedures, also through project finance), in order to valorise public and private real estate assets.
Studio Carullo assists entrepreneurs in the construction branch by dealing with legal affairs relating to the conception, management and finalization phases of a real estate construction operation including the care and management of the area sourcing phase, the area suitability study, of the drafting and assistance in the prodromal phase of the sale of the same through the identification of the best contractual instrument.
The Firm also assists the Clients in drafting the tender contracts for the construction of the complex, in the study of the tax breaks that the urban project can enjoy, also with regard to the recent regulatory changes referred to in the superbonus – deduction of expenses incurred by the buyers of the so-called . anti-seismic buildings – Article 16, paragraph 1-septies of the decree law 4 June 2013, n. 63 – Articles 119 and 121 of the decree law 19 May 2020, n. 34 (relaunch decree).
The firm assists its clients in the litigation and appeal phases concerning the issue of building permits or their denial and the onset of any problems connected to the performance of building activities deemed abusive.
